COURT OF APPEAL, CALABAR AFFIRMS SEN. OBA OF AKWA IBOM NORTH EAST (UYO) SENATORIAL DISTRICT WINNER OF 2019 ELECTION

The Appellate Court sitting in Calabar on Friday 17th October, 2019 has declared and affirmed  Distinguished Senator Bassey Albert (OBA) as the winner of Akwa Ibom North East (Uyo) Senatorial District as earlier affirmed to by the Election Petition tribunal in Uyo.

The Court of Appeal settled on the first Issue raised by the Appellant, Mr Bassey Etim of APC being eligibility- age declaration and place of birth, and dismissed the issue against the appellant. On the second issue
which is Certificate and forgery, the court equally dismissed it as the mistake of fact did not proof an intent of forgery.

The Appellate Court which is the concluding court on post Election matter as regards National Assembly elections issues also ruled on the third issue which is indictment by an administrative Panel of Inquiry that the respondent Distinguished Senator Bassey Albert (OBA) is not guilty and resolved against the appellant as well. On the fourth issue which is the results of the election, the court ruled that it could not be controverted as the appellant could not substantiate the allegations of malpractice in the various units where elections were conducted and ruled in favour of the respondent Senator OBA and dismissed against the appellant.

Recall that following the unanimous judgment of the National Assembly Election Petition tribunal in Uyo recently in favour of Distinguished Senator Bassey Albert (OBA) of PDP, the Court of Appeal had to entertain an appeal raised by Mr Bassey Etim of APC at the court which first came up on Tuesday 8th October, 2019 behind Cross River State Secretariat, calabar.

The Appellate court had to adjourn till 14th October, 2019 to enable the respondents reply on point of law to the briefs in the appeal in view of the short notice of service and initially fixed judgment for the following day 15th October, 2019 but could not deliver on its promise due to an emergency petition raised by the Appellant's party APC on the day of judgment thereby allegedly making the court to react to the issues raised with appropriate authorities and thereafter promise to communicate a new date for judgment to the litigants.

As at Thursday 17th October, 2019 the court did communicate that judgment is for Friday 18th October, 2019 and in its landmark judgment has re-affirmed the people's Senator OBA as the authentic winner of the 2019 National Assembly election in Akwa Ibom North East (Uyo) Senatorial District

Meanwhile , Uyo is agog with celebrations of the Senator's victory as announced by the Appellate court because he has a huge connect with his people who gave him the mandate and Akwa Ibom people .

Some supporters of Senator OBA defied the dilapidated Calabar -Itu Highway to travel to Calabar in solidarity of Distinguished Senator Bassey Albert (OBA) representing Akwa Ibom North East (Uyo) Senatorial District and Leader ,Akwa Ibom Caucus in the National Assembly in the 9th Senate to witness the landmark judgment of the Appellate Court.
